This English version is a translation for convenience. If it differs from the Japanese version, the Japanese version prevails.
These Terms of Use ("Terms") set out the conditions for using the iPhone app Walk with Cat (the "App") and this website, provided by NilOne Ltd. ("we" or "us").
1. Scope
By using the App, you agree to these Terms. Apple's App Store terms also apply to downloading the App and making purchases. If you are a minor, please get permission from a parent or guardian before using the App.
2. Using the App
The App is free to download and can be used without creating an account. You are responsible for the cost of your device and data connection. Reading your steps requires permission for Motion & Fitness on your iPhone or for Apple's Health app.
3. In-app purchases and Paws
Paws, the in-app currency, are earned by walking and can also be bought in packs through App Store in-app purchases. Apple handles the purchase and payment. Paws can be used inside the App for things like making toys, outfits, shops in the towns you visit and new destinations. Except where required by law, Paws cannot be exchanged for cash or other services, refunded, or transferred to another person. Paws do not expire.
4. Cancellations and refunds
Because these are digital items, purchases cannot be cancelled once completed. Refunds follow Apple's rules; please request one from Apple's "Report a Problem" page (reportaproblem.apple.com).
5. Your records
Your steps, photos, trip progress, Paws and other records are stored on your device. Deleting the App deletes these records. "Restore purchase" only brings back one-time purchases made with the same Apple Account; it does not bring back Paws or trip records.
6. Prohibited conduct
Please do not modify, reverse engineer or copy the App; obtain Paws or other items through bugs or improper means; infringe the rights of NilOne or others; interfere with the operation of the App or this website; or break the law or public order and morals.
7. Rights
The rights to the artwork, text, sounds and other content of the App and this website belong to NilOne or the rightful owners. You may save the photos taken in the App and share them, for example on social media, for personal enjoyment.
8. Changes, suspension and ending the service
We may change the App's content, suspend it temporarily or end it. If we end the App, we will announce it in advance in the App or on this website and handle Paws in accordance with the law.
9. Disclaimer
Steps and distances in the App are based on records from your iPhone, Apple Watch and the Health app, and their accuracy is not guaranteed. The App is not intended for medical or health-management purposes. Except in cases of our intent or gross negligence, we are not liable for damages arising from use of the App. Where laws such as consumer protection law make this provision invalid, those laws apply.
10. Changes to these Terms
We may change these Terms when necessary. When we do, we will update this page and its date, and announce important changes in the App or on this website. By using the App after a change, you agree to the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute regarding the App shall be subject to the exclusive jurisdiction, in the first instance, of the district court that has jurisdiction over our head office.
